MCI Gives “Final Opportunity” To Dr. Ketan Desai: Moves “Higher Judicial Forum” Against the Gujarat Medical Council For Non-compliance Of Previous Order

In another new twist to the ongoing saga of involving the disgraced ex-MCI chief, Dr. Ketan Desai, in an email to PBT president Dr. Kunal Saha (who lodged an appeal seeking cancellation of Dr. Desai’s medical license), Dr. Reena Nayyar, MCI deputy secretary has informed that the Ethics Committee has given a “final opportunity” to Dr. Desai to appear before the council as during the last hearing on May 10, 2011, neither Dr. Desai nor his legal counsel appeared before the Ethics Committee.  However, the Ethics Committee has unanimously decided to ask the Board of Governors (BOG) to move the “higher judicial forum” for appropriate action against the Gujarat Medical Council (GMC) for non-compliance of MCI’s previous order dated October 9, 2010 in which MCI decided to summarily suspend Dr. Desai’s medical registration pending a full investigation of the complaint by Dr. Saha but the GMC refused to suspend Dr. Desai’s license as they claimed that MCI has no legal right to order GMC for cancellation of license of a registered doctor (see the MCI letter below).  As reported earlier, on a related but different matter, the Supreme Court of India has already issued a notice to Dr. Desai seeking explanation as how he managed to become a member of the Gujarat University Senate even after his license was suspended by the MCI.  This case is listed for final hearing in the Apex Court on July 8, 2011.
