Doctor With Suspended Registration Continues Practice At Apollo Gleneagles Hospital In Kolkata: PBT Lodges Complaint Against Police Inaction

West Bengal Medical Council suspended practicing license of a urologist, Dr. Vinay Mahendra, for a period of two years starting last November for medical negligence. Even MCI website has been showing Dr. Mahendra’s suspended registration status in the Indian Medical Register. But all this was no problem for Dr. Mahendra as he continues to treat numerous patients every day at Apollo Gleneagles Hospital, the top private medical center in Kolkata. In fact, Apollo hospital continues to glorify Dr. Mahendra on their website with his attractive pictures and superlative accolades claiming how great a doctor he is only to entice the unsuspecting patients.

Earlier this month, PBT lodged a formal criminal complaint for fraud, deception and illegal medical practice against Apollo hospital and Dr. Mahendra with Phoolbagan Police Station that has jurisdiction over the hospital. The acting O.C., Mr. Suman Naskar, assured that he would take immediate action considering the serious nature of PBT’s complaint. But three weeks later, Phoolbagan police has not even registered an FIR in brazen violation of numerous judgments from Supreme Court of India as Dr. Mahendra has continued to practice at the same Apollo hospital as late as today (April 25), as verified by PBT. PBT has sent a formal complaint with the Police Commissioner, as stipulated under Criminal Procedure Code, 1973, seeking immediate intervention and exemplary disciplinary action against the devious police officer at Phoolbagan Police Station. Unless Police Commissioner acts promptly against this police inaction and take adequate criminal action against the errant doctor and Apollo Hospital, PBT may move the appropriate court of law in demand of equitable justice.

    In my case, a consultant of the same hospital was refused anticipatory bail by the District judge and subsequently by the Calcutta High Court. He was declared absconder by the trial court. I guess he kept on practicing as usual in the hospital and got the bail once the charge sheet was filed .

    Had been to Phoolbagan PS last week and met Mr. Suman Naskar in connection with the criminal case GR/961 of 2010 against the health care workers of the same hospital. It was shocking to know that the concerned PS has no information about the development of the same case in the Calcutta High Court and the Supreme Court of India. In both the High Court and the Supreme Court, Govt of West Bengal is no 1 opposite party. I had moved the High Court against the decision of the lower court discharging four accused without my knowledge. The High Court gave me the partial relief and cancelled the discharge of one nurse Rossy M Joseph. Then I filed a SLP in the Supreme Court and the notice has been served to the remaining three. Yesterday, there was my evidence in the trial court but it was not started as the police has failed to produce the concerned nurse before the court. There is no coordination between the court and the police. In spite of my repeated requests the hospital authority did not give me the registration no and the qualifications of the concerned nurse. This raises big question whether she was simply a show piece or a qualified nurse. The observation of the Calcutta High Court regarding that nurse ” But there is apparent gross negligence on the part of the attending nurse Rossy M Joseph and she cannot be discharged at this stage”. I had gone to Kolkata all the way from Delhi to depose before the court ! Above all the case is Govt of WB vs …….!

    This don’t care attitude is solely responsible for taking the life of our dearest ones.

    My niece is victim of medical negligence by Dr, Vinay Mahendra.
    She had urination problem with difficulty in emtying bladder . Dr Mahendra carried out cystoscopy and urethral dilation at Apollo , Kolkata which possibly was not required in her case at all . But he carried out the operation hurriedly in order to meet his target of the nursing home. After operation he didn’t care for after operation follow up even behaved very rudely when we tried to contact him for her problems. After operation her problem didn’t improve at all on the otherhand lot of other complications appeared. We had to consult all sort of specialists at Kolkata for last three years but without any soltion to her problem . Now we have taken her to NIMHANS Bangalore. She is there under treatment for last three weeks . Let us pray they find a solution to her problem
    I never thought that doctor who is in such noble profession can be a such inhuman being.
