Kunal Saha Sends Legal Notice To W.B. Medical Council President For Making Slanderous Comments That PBT Is “Cheating” People

Lawyer on behalf of PBT president, Dr. Kunal Saha, sent a legal notice to West Bengal Medical Council (WBMC) president and Trinomul-Congress MLA, Dr. Nirmal Maji demanding a public apology after Dr. Maji made baseless and slanderous comments last week after MCI directed to investigate Dr. Maji and two other doctors for their role in alleged dialysis of a pet dog at SSKM Hospital, a premier super-specialty government medical center in Kolkata following complaint lodged by Dr. Saha. In an interview published on 15th November, 2017 in a popular Bengali daily Eisamay in relation to the news of dog’s dialysis, Dr. Maji was quoted to have said that Dr. Saha has been “cheating” people of West Bengal through his charitable organization (PBT). In the same interview, Dr. Maji also threatened that WBMC would take steps to cancel medical registration of Dr. Saha who is originally a physician from Kolkata and registered with WBMC although he has been settled permanently in USA (as an HIV/AIDS specialist) for the past more than two decades. The legal notice sent by Dr. Saha’s advocate has further stated that if Dr. Maji fails to send a satisfactory response within 10 days, Dr. Saha may have no other option but to move the court of law for the ends of justice. PBT was established by Dr. Saha in 2001 and over the 16 years, PBT has been helping countless victims of medical negligence to find justice and trying to cleanse the rot in Indian healthcare system through public interest litigations (PILs) in Supreme Court and High Courts across India.

    Dr. Saha and PBT are helping medical negligence victims selflessly. PBT don’t need a certificate from WBMC. Dr. Maji should be punished for his words.

    My wife did go thru and suffer at the hands of the most reprehensible nexus of greed & acts of negligence closely associated with each other.Mine & my families’ happiness was robbed by Doctors treating a small cancerous nodule of 2 cms in 2001 thru a well proclaimed ‘Breast conservative surgery’simplest Surgeory in a so called ‘most leading Cancer Hospital’ of Delhi.She was highly over radiated & drugged during Chemotherapy seriously damaging Lungs Brain & bones.That too in utter violation of predecided Treatment Plan.
    Without any prior check up of the condition of heart much higher dosage of highly toxic drugs were administered due wrong recording of substantially higher Body weight and also persisting with same higher dosage till the end of chemotherapy.Her Brain cells were severely damaged. My wife, as a result of the above brutalities having been left unchecked by the Medical Director & the Hospital, had to undergo most unwarranted miseries,sufferings for over 11 years when she died prematurely at the altar of Greed.
    The mechanism devised by the Apex Court to ensure that the concerned Doctors are protected against undue harassment & deep pockets of the Medical industry are proving extremely dilatory for the concerned patients,their families.All this if not corrected will seriously jeopardise peace and well being in the society including a set back to National Plans of promotion of Medical Tourism to earn valuable foreign exchange.
    So much is at stake but effective steps to counter the menace & improve have proved ineffective.

    W.B MCI is extremely inefficient.
    My mother had died because of a doctor’s medical Negligence and it’s been 14 years no action has been taken against him by WB MCI.
    Irrespective of my father’s evident prove against the doctor.

    I too support Dr. Kunal Saha and admire him for doing this work, which should actually be done by our inept and corrupt medical councils!

    My wife became a victim of unscrupulous greedy doctors and a money fleecing private hospital run by non professionals in medical streams ,in 2005 at Chandigarh.She was given a highly potent injection without any diagnosis by an unregistered doctor(Quack) under false scare of death.As a result her vitals were seriously damaged and she had to undergo bed ridden life of pains and sufferings for 12 years and prematurely died in August 2017. She had wished me to take a severe legal actions against this greedy nasty element . I had taken a cue from Dr Kunal Saha when I met him at Delhi in 2006 when he was struggling for justice with National Consumer Disputes Redressal Council for the sad demise of his wife- victim of gross medical negligence.I filed criminal case against doctors and the hospital.The main doctor Jayant banerji has fled from the country and the Inscol hospital has been closed down.I contested the cases in person against this unsocial element twice in high court and twice in the Hon’ble Supreme Court and National Commission and now busy writing a book under the title “Modern India, the sovereign State of Hypocricy ” all about the irregular practices in vogue in judicial and medical systems as experienced by me during my struggle for 12 years. There is no effective medical regulatory body though fundamental right to health is enshrined in the Constitution of India.There is too much honesty among thieves whose main aim is grabing money and money and more money without caring for miseries and tortures caused to others. I owe my gratitude to Dr Saha who inspired me to rise stand against the unscrupulous element of our society detrimental at large.
