PIL To Stop Disgraced Dr. Ketan Desai From Becoming World Medical Association President Adjourned Again By Delhi High Court

Although Delhi HC division bench headed by the Chief Justice called on Jan 6, 2016 the PIL filed by PBT (W.P. No. 9597/2015; People for Better Treatment vs. MCI &Ors.), which was listed for ORDER, the court simply adjourned the matter to 8th February, 2016 without passing any order. The principal prayer in this PIL has been to direct MCI and Union of India to take appropriate steps to prevent disgraced ex-MCI president, Dr. Ketan Desai, from assuming the prestigious post of the president of World Medical Association (WMA) which he is expected to take over in October, 2016. The primary allegations in this case involve top IMA and MCI officials deliberately provided false and fabricated information to the WMA in order to make Dr. Desai president-elect of this international world medical body in order to rebuild Dr. Desai’s badly tainted public image and to bring him back at the helm of Indian healthcare.

This PIL was strenuously argued on 9th October, 2015 by senior advocate, Mr. M.N.Krishnaani, on behalf of PBT, after Govt. of India, MCI and IMA all raised the issue of “maintainability” in support of Dr. Desai as the court reserved the case for ORDER to be delivered on 2nd November, 2015. When 2nd November came, the PIL was further adjourned to 6th January, 2016 without any further hearing and yesterday (Jan 6), this important matter was again adjourned to 8th February, 2016.

PBT is particularly concerned with the present developments with this PIL due to the fact that only few months are left before the disgraced Dr. Desai, still with a suspended medical registration, would be put to the coveted post of WMA president unless this writ petition is allowed and MCI and Govt. of India take necessary measures to stop Dr. Desai. If time runs out and Delhi HC fails to make any decision before Dr. Desai becomes WMA president in October, the entire PIL would become totally infructuous. That would be a true travesty of justice for the entire nation and would send a wrong message to the hapless patients of India.

    There is no force on this earth, since God is with PBT, to stop our efforts to bring to light the alleged misdeeds of and bring deserving justice to Dr. Desai. The game the concerned Justice of Delhi High Court has been playing to this effect is nothing new. It is very easy to understand. So, what should be done? The best remedial course, my humble suggestion without prejudice, is to redirect this mail to the Hon’ble Chief Justice of India for his information and immediate intervention in the interest of Justice and to maintain purity of judiciary.

    I read this news and felt bad. Delhi high court is also playing the game regarding the fight against Dr. Desai. We should not give up this fight. Our fight will be continued unless it is solved. We must win . As per Mr. Chakrabarti, please write to Chief justice of India regarding this case. let us see what will happened on February 8, 2016.

    The adjourning bench was headed by the new chief justice of India, in whom a lot of people pinned their hopes for stamping out corruption and the highly contaminated VIP culture? Hmmm….

    I agree with Mr. Ganesh Mandel, that we should not give up and our fight should continue till we get justice. We should form big circle and start attacking in all angles by distributing the task. Instead of mainly concentrating on one person Dr. Ketan Desai, we should attack all the areas such as MCI etc. and start questioning area of their revenue by way of corruption. Further, Instead only one person i.e Dr. Saga, concentrating the attack, we should start attacking by involving 100 or 1000 persons by RTI request etc. on issue such corruption in medical college admission, FMGE issues, etc. This will really push them back. I request let us plan in a big way.

    It makes me wonder whats happening to India and its legal system. Maybe this is “Kalyug” when a man is nothing more than another animal species. Truly a shame!!

    He is within his right to ask for the reason from the bench and also request it to be recorded so it becomes part of case record.
