Cancellation of Dr. Ketan Desai’s License: Gujarat High Court Issues Notice Against Gujarat Medical Council

In a major development in the sordid saga of disgraced ex-MCI chief, Dr. Ketan Desai, the Division bench of Justices Mr. V.M. Sahai and Mr. A.J. Desai of Gujarat High Court has issued notice today against Gujarat Medical Council (GMC) for not suspending the medical license of Dr. Ketan Desai. PBT filed an appeal in Gujarat HC against GMC’s deliberate refusal to cancel Dr. Desai’s medical registration since 2010 (see the appeal below).  The court has also directed to add Dr. Desai as a respondent in this case and directed GMC to file a response affidavit by May 2, 2012.

After Dr. Desai was arrested by the CBI for taking bribe from a private medical college in April, 2010, PBT filed a complaint (through PBT president Dr. Kunal Saha) with the GMC seeking to cancel Dr. Desai’s license for his deplorable and unethical activity.  After GMC deliberately stalled the investigation for months, PBT filed an appeal with the Medical Council of India (MCI).  In an order dated October 9, 2010, MCI decided to summarily suspend Dr. Desai’s medical registration but GMC has staunchly defended Dr. Desai and refused to cancel his license until now.  Ironically, Dr. Desai himself remained as the GMC president while a complaint against him was allegedly investigated by the council.  After a single-judge bench of Gujarat HC dismissed the initial complaint against GMC last year on the ground that MCI should take the necessary action, PBT moved the division bench which has accepted our appeal and issued the notice today.

Dr. Ketan Desai is a sheer disgrace for healthcare in India.  Dr. Desai has also brought endless ignominy for all doctors of Indian origin (see article in international medical journal “Lancet” below).  But even after Dr. Desai was caught “red-handed” by the CBI for taking bribe in 2010, he was elected “unopposed” to become a member of the Gujarat University (GU) Senate in 2011 which has paved the way for his return to the MCI.  PBT has already moved the Supreme Court against Dr. Desai’s botched election to the GU Senate and we will continue to fight medical negligence and pervasive corruption in Indian healthcare by Dr. Desai and his cronies.
